These Terms of Service (“Terms”) establish the conditions under which Puka Studio Lukasz Jadczak, operating under the brand “WorkGurus” (“Company,” “we,” or “us”), offers access to and usage of the “Job Search Master” online course (“Course”). By accessing, purchasing, or using the Course, you (“User,” “you”) expressly agree to abide by these Terms. If you disagree, you must immediately cease using our services and close your User account.

  1. Course Description and Licence

The “Job Search Master” Course provides detailed, video-based content complemented by interactive PowerPoint presentations, designed explicitly to assist Users in overcoming job search challenges, enhancing professional confidence, identifying hidden opportunities, and securing rewarding employment. Upon successful payment, instant access to Course materials is granted.

The User is provided with a permanent, non-exclusive, non-transferable license for personal, non-commercial educational purposes only. Access to the Course is granted for an unlimited duration with no expiration date. Any other use, including but not limited to copying, redistributing, modifying, selling, sublicensing, or creating derivative works, is strictly prohibited without prior explicit written consent from the Company.

  1. User Accounts, Payments, Refund Policy, and Complaints

Users must create an individual account to access the Course. Payments are securely processed through credit/debit cards, PayPal, PayU, and RazorPay. The accepted currency is Indian Rupees (INR). Once payment is confirmed and access is granted.

In the event of technical issues preventing access to the Course after purchase, Users are entitled to submit a complaint at any time. Complaints should include a detailed description of the issue, the email address used for registration, and proof of payment. All complaints will be reviewed within 14 working days, and if the issue is validated, the Company will take reasonable steps to restore access or provide an appropriate resolution.

Users are responsible for maintaining the confidentiality of their login details and must notify the Company immediately if unauthorized access is suspected.

Notwithstanding the foregoing, Users are eligible for a 100% refund only if they request it within 7 days after they initially purchased access to the Course and only after they complete and submit the Satisfaction Survey (Refund Claim Section) available at the end of the Course (or Module, if a single Module was purchased). Upon positive verification of the information provided by the User in his Refund Claim submission, a 100% refund will be issued to the User’s account within 30 days from the moment of Refund Claim submission. User’s access to the Course/Module will be automatically terminated upon the receipt of the Refund Claim. 

  1. Intellectual Property Rights

All Course materials, including videos, presentations, texts, images, graphics, trademarks, and other content, are protected by intellectual property rights owned exclusively by the Company. Unauthorized downloading, reproduction, redistribution, modification, or commercialization of this content is strictly forbidden and may result in legal proceedings.

  1. Liability, Disclaimer, and Warranty

The Course content is provided on an “as-is” and “as available” basis without any explicit or implied warranties regarding accuracy, completeness, effectiveness, suitability, or outcomes. The Company explicitly disclaims liability for any direct, indirect, incidental, special, consequential, or exemplary damages arising from the use or inability to use the Course materials.

The Course does not constitute professional career advice and should not be considered as a substitute for such advice. Users are advised to apply their own judgment and utilize the Course content at their own risk.

  1. Privacy and Data Protection

The Company collects minimal personal data essential for providing Course access (name, email address, payment details). Payments are securely processed via Razorpay, Stripe, and PayPal, and analytics services are provided by Google Analytics. Personal data collected will not be utilized for marketing or advertising purposes nor shared with unauthorized third parties.The processing of personal data adheres strictly to the Company’s Privacy Policy, available separately on our website.

  1. Testimonials and Marketing Permissions

If as a User, you voluntarily submit a testimonial, review, survey response, photograph, name, likeness, or other content (“Testimonial Content”) and select an option allowing marketing use, you grant the Company a worldwide, non-exclusive, royalty-free license to use, reproduce, display, publish, distribute, and create excerpts/edits of the Testimonial Content for the purposes of promoting the Course and the Company’s services, including on our website, social media, advertisements, and other marketing materials.

You represent and warrant that (i) you have the right to grant this license, (ii) the Testimonial Content is truthful to the best of your knowledge and does not infringe any third-party rights, and (iii) you understand no compensation is owed for such use.

You may withdraw your permission for future marketing use at any time by contacting us at lukasz.jadczak@myworkgurus.com. Upon withdrawal, the Company will cease new marketing use within a reasonable time and will make reasonable efforts to remove the Testimonial Content from future publications and placements under our control; however, you acknowledge that removal from third-party platforms, cached pages, or past distributions may not be immediate or fully possible.
To the maximum extent permitted by law, you agree not to make any monetary claim against the Company solely for the Company’s permitted use of the Testimonial Content in accordance with this section. This does not limit any rights that cannot be waived under applicable law.

  1. Termination of Access

The Company reserves the unequivocal right to immediately terminate or suspend your account and access to the Course if you violate these Terms, misuse Course content, engage in harmful, disruptive, illegal, or unethical conduct, attempt unauthorized redistribution, or otherwise compromise website security.

Either party may deactivate the User account without prior notice, reason, or further obligation.

  1. Modifications to Terms

The Company reserves the right to modify, amend, or update these Terms at any time. Notification of significant changes will be communicated via our website. Continued use of the Course after updates constitute your explicit acceptance of the revised Terms.

  1. Governing Law and Dispute Resolution

These Terms are exclusively governed by and construed according to the laws of Poland and applicable European Union legislation. Any disputes arising from or in connection with these Terms shall first be resolved through good-faith mediation conducted in Warsaw, Poland. If mediation is unsuccessful, disputes will be submitted to the jurisdiction of courts located in Warsaw, Poland.

Special Notice for Users Located in India

Users residing in India acknowledge explicitly that the purchase and use of the Course constitute an international transaction, governed by Polish and European Union laws. Users expressly consent to the international nature of this agreement, including the resolution of disputes as stipulated above.

  1. Indemnification

Users agree to indemnify and hold harmless the Company, its affiliates, directors, officers, employees, and representatives against any and all claims, liabilities, damages, losses, or expenses, including reasonable attorney fees, arising from the User’s breach of these Terms, misuse of Course materials, infringement of intellectual property rights, or engagement in prohibited activities.

  1. User Conduct

Users must engage respectfully and professionally with other Users and Company representatives. Users must refrain from defamatory, abusive, obscene, offensive, discriminatory, or illegal conduct or actions detrimental to the Company’s reputation or services. The Company reserves full authority to remove inappropriate content, restrict user privileges, or terminate access at its discretion.

  1. Force Majeure

The Company shall not be liable for any failure or delay in performing its obligations under these Terms if caused by circumstances beyond its reasonable control, including but not limited to acts of God, governmental restrictions, wars, natural disasters, pandemics, power outages, internet disruptions, or cyber-attacks.

  1. Entire Agreement

These Terms represent the complete and exclusive agreement between the User and the Company regarding the Course and supersede all previous understandings, agreements, or communications, written or oral.
